Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Leeward House Thornbury, its employees, agents, contractors, and affiliates from any claims, damages, or liabilities arising from your participation in or receipt of text messages from our program.

Dispute Resolution

All disputes regarding these Messaging Terms or your use of the program will be resolved by binding arbitration. BY AGREEING, YOU WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS

ACTION. However, you or Leeward House Thornbury may bring individual actions in small claims court, seek enforcement through local agencies, seek injunctive relief from a court, or file for intellectual property infringement claims.

You and Leeward House Thornbury agree to bring claims only in individual capacity — not as a class or in a representative proceeding. If any part of these Terms is found unenforceable, the remaining portions remain fully enforceable.
